Welcome to Moofers Clothing!

These Terms of Service (“Terms”) govern your use of our website, webshop, and physical store located at 22 Toussaintkade 2513CK Den Haag, The Netherlands (“Store”). By accessing or using our website and/or purchasing products from our Store, you agree to comply with these Terms. If you do not agree with these Terms, please do not use our services.

1. Acceptance of Terms

By accessing or using our website and/or Store, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, please refrain from using our services.

2. Eligibility

To use our website or make a purchase in our Store, you must be at least 18 years of age or have the legal capacity to enter into binding contracts in your jurisdiction. By using our website or Store, you represent and warrant that you meet these eligibility requirements.

3. Products and Services

We offer clothing and accessories for sale through our website, webshop, and in-store at our physical location. All products and services provided are subject to availability, and we reserve the right to modify or discontinue products without notice.

4. Ordering and Payment

  • Online Orders: When placing an order on our website, you agree to provide complete and accurate information, including payment details. We accept payments via iDEAL, Wero, credit/debit cards and bank transfer.
  • In-Store Purchases: When shopping in-store, you agree to pay for products using the available payment methods, which may include cash, debit cards and credit cards (VISA and MasterCard). In-store purchases may be subject to different terms, including those regarding returns and exchanges.

By submitting an order online or making a purchase in-store, you are offering to purchase products in accordance with these Terms.

5. Pricing and Availability

  • Online: All prices on our website are subject to change without notice. We make every effort to ensure that product descriptions and prices are accurate, but errors may occur. In the case of pricing or availability errors, we reserve the right to cancel or amend orders accordingly.
  • In-Store: Prices in the Store may vary from those listed on our website. If an item is on sale or promotion in-store, it may differ from online pricing. We strive for accuracy but cannot guarantee that all products in-store are available at the same prices as listed online.

6. Shipping and Delivery

  • We ship worldwide. All orders are delivered to you by PostNL (NL), UPS or DHL. Please note when you are ordering from outside the EU duties and tax are not included in the price. You have to pay these on delivery. Shipping costs are calculated at checkout, and delivery times vary depending on the shipping method selected.
  • Delivery times are for The Netherlands & Europe: 3-5 business days and for the rest of the world: 5-10 business days. Delivery times are estimates and start from the date of dispatch. Please note that in some areas there is a limited range of delivery services available. We will endeavour to send your order out as quickly as possible, but we cannot be responsible for delays as a result of remote delivery locations or adverse weather conditions.
  • When placing your order, please ensure that the billing and shipping address details are correct, as we are unable to redirect. When your order is shipped, we will send you a confirmatory email with a track & trace number so that you can easily track your order.
  • In-Store Pickup: If you choose the in-store pickup option for your online order, you must collect your items at our physical store. You will be notified once your order is ready for pickup.

7. Returns and Refunds

  • Online Returns: If you wish to return any item(s) from your order, please notify us of your decision to do so as soon as possible but at least within 14 days of delivery. To initiate a return, please contact us at +31 70 7430138 or info@moofers.nl.

  • Items must be undamaged and in sellable condition and must be returned in their original box, with all garment tags attached. Returns that have been worn, used, altered, or damaged will not be accepted and may be sent back to you and/or a refund refused. We cannot be held responsible for any missing returns or items whilst in transit.
  • In-Store Returns: In-store purchases can be returned within 14 days of purchase, subject to the same conditions: items must be unused, in original condition, and with the receipt. For exchanges or returns, please visit our physical store or contact us at +31 70 7430138 or info@moofers.nl.
  • If all correct, we will refund the full purchase value of the returned item.

8. Intellectual Property

All content on the Site, including but not limited to images, text, logos, trademarks, and product descriptions, is the property of Moofers Clothing / Moofers B.V. and is protected by intellectual property laws. Unauthorized use of our content is prohibited.

9. User Conduct

You agree to use the website and our Store for lawful purposes only. You may not:

  • Violate any applicable law or regulation
  • Infringe the rights of others
  • Distribute harmful or malicious content
  • Interfere with the security or operation of our website or Store

10. Privacy

Your use of our website and Store is governed by our Privacy Policy, which explains how we collect, use, and protect your personal data.

11. Limitation of Liability

To the maximum extent permitted by law, Moofers Clothing / Moofers B.V. is not liable for any indirect, incidental, special, or consequential damages arising from the use of our website, online services, or physical Store, or from the purchase of our products.

Our total liability for any claim related to these Terms shall be limited to the total amount you paid for the product(s) in question.

You agree to indemnify and hold harmless Moofers Clothing / Moofers B.V., its affiliates, officers, directors, employees, and agents from any claims, damages, liabilities, or expenses arising from your use of our website, Store, or violation of these Terms.

13. Amendments to These Terms

We reserve the right to update or modify these Terms at any time. Any changes will be posted on this page with the updated date. By continuing to use the website or Store after such changes, you agree to the revised Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of The Netherlands, without regard to its conflict of law principles.

15. Dispute Resolution

In the event of a dispute arising out of or relating to these Terms, the parties agree to attempt to resolve the dispute through mediation before resorting to legal action. If mediation is unsuccessful, the dispute shall be resolved by arbitration in Den Haag, The Netherlands.
